Terms & Conditions
Last updated November 2, 2026
These Terms & Conditions ("Terms") govern your use of aqualightsnc.com and any request for, booking of, or payment for services from Aqua Lights, a holiday lighting brand operated by Aqua Cleaning ("Aqua Lights," "we," "us," or "our"). By using our website, requesting a quote, approving a design, or allowing us to perform services at your property, you agree to these Terms. If your signed quote or agreement says something different from these Terms, your quote or agreement controls.
Our services
We provide residential and commercial Christmas lighting, which may include custom design, personalized mockups, supplied lighting materials, installation, in-season maintenance, removal, and off-season storage ("Services"). The exact scope for your property is defined in your quote, invoice, or written agreement.
Quotes, mockups, and changes
- Quotes are based on the information available to us, including details you provide. If conditions at your property differ from what was represented, or you request changes, we may revise the price or scope.
- Mockups are illustrations meant to show the design concept. The finished display may differ in appearance, including bulb placement, spacing, brightness, and color.
- Images on our website are illustrative unless stated otherwise.
The lights remain ours
Aqua Lights keeps ownership of the lights and other materials we supply, unless your written agreement says otherwise. You don't buy them through our standard service, and you may not sell, move, alter, or remove them, or allow anyone else to, without our permission. We may reuse, replace, or substitute materials of comparable quality.
Scheduling and weather
Appointment times and installation or removal dates are estimates, not guarantees. We may need to reschedule because of weather, equipment problems, emergencies, or unsafe conditions, and we will tell you as soon as reasonably possible.
Cancellations
Please contact us as early as possible if you need to cancel or reschedule. Any deposit, cancellation terms, and charges for materials or work already completed are as stated in your quote or agreement, to the extent permitted by law. If we arrive and can't access the property or perform the work because of issues outside our control, a trip fee may apply.
Your responsibilities
You agree to:
- Confirm that you own the property or have authority to approve the work
- Obtain any approvals you need, including from an HOA, landlord, property manager, or historic district or local authority
- Give us safe, unobstructed access to the work areas for installation, maintenance, and removal, including securing pets and unlocking gates
- Provide working, properly grounded exterior electrical outlets or other agreed power, and pay for the electricity the display uses
- Tell us about hazards and known issues before we begin, such as electrical problems, fragile or damaged roofing, gutters, trim, or siding, wasp nests, and unstable ground
- Remove or secure fragile items near the work areas
- Tell us about underground utilities, irrigation lines, or similar items if pathway lights or ground stakes are part of your design
Installation and property conditions
Installing a display involves working on and around your home or building and attaching lighting to it. Minor, ordinary marks can occur. We are not responsible for damage caused by pre-existing conditions, including aged, loose, or deteriorated roofing, shingles, gutters, trim, paint, or siding, or by defective installation or construction, overloaded or faulty electrical systems, or normal wear. Trees and plants are lit only where suitable, and we are not responsible for their existing condition or natural decline.
In-season maintenance
If maintenance is part of your Services, tell us if part of your display stops working by calling or texting (919) 813-7560. We will address covered issues within a reasonable time. Repairs may be limited or delayed by weather, access, or safety. Damage caused by storms, power events, animals, vandalism, theft, or tampering may be subject to additional charges where permitted by law.
Removal and storage
If included in your Services, we will remove the display after the holiday season and store the materials we own. Please give us access for removal. Timing depends on our schedule and on weather. We are not responsible for storing items that belong to you unless we agree to it in writing.
Results and concerns
We aim for professional-quality work. If you have a concern about your display, please tell us as soon as you notice it, so we can evaluate it and address it if appropriate.
Photos
We may take photos or videos of completed displays for documentation, quality control, training, or marketing, and we will avoid personally identifying details where reasonably possible. If you don't want your property used in marketing, tell us in writing before service.
Payment
Prices, deposits, and due dates are as stated in your quote, invoice, or agreement. We accept the payment methods we tell you about at booking or on your invoice. Late payments may be subject to fees and collection costs as permitted by law.
Text messages
If you opt in to text messages, you may receive messages about quotes, scheduling, confirmations, service updates, reminders, review requests, and occasional promotions. These messages may come from or refer to Aqua Cleaning, which operates Aqua Lights. Message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. Consent to receive texts is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.
Website content
The content, logos, graphics, text, and branding on this website belong to us or our licensors, and may not be copied or used without written permission. Our website may link to third-party websites, and we are not responsible for their content or practices.
Disclaimer of warranties
Except as stated in a written agreement, and to the extent permitted by law, our website and Services are provided "as is" and "as available." We do not promise uninterrupted website operation or uninterrupted performance of any display.
Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost use, or inconvenience.
- For claims not involving direct physical property damage caused by our negligence, our total liability will not exceed the amount paid for the specific Service giving rise to the claim.
- If direct physical property damage is proven to have been caused by our negligence, our responsibility is limited to the reasonable cost to repair the damaged portion, or to replace the damaged component if repair is not feasible, subject to these Terms.
Nothing in these Terms limits liability where such a limit is prohibited by law, including for gross negligence or willful misconduct where applicable.
Indemnification
To the extent permitted by law, you agree to defend and indemnify us against claims arising from your breach of these Terms, unsafe conditions at your property that you did not disclose to us, your failure to obtain a required approval, or your misuse of the website.
Governing law and venue
These Terms are governed by North Carolina law. Any dispute will be brought in a court of competent jurisdiction in or nearest to Durham County, North Carolina, unless otherwise required by law.
Severability and updates
If any provision is found unenforceable, the rest remain in effect. We may update these Terms from time to time and will post the updated version here with a new "last updated" date. Updates don't change a signed agreement already in place.
